Exclusive: Man Details Traffic Stop Involving Mayor Davis

SOUTHAVEN, MS (abc24.com) - The man pulled over last week by Southaven Mayor Greg Davis says he had no idea the man wasn't a police officer.

"I called him officer," Nick McCune said in an exclusive interview with abc24.com. "I said, 'Sorry, officer.'"

McCune says he was driving home last Thursday when the unmarked white SUV pulled him over.

"He walked up to my car and said, 'Give me your driver's license and insurance,' and I said, 'Yes Sir officer, I'm so sorry.'"

McCune says he had no idea the man was Mayor Greg Davis until we told him Wednesday evening.

"He looked like a detective, so I thought I got pulled over by a big guy, but it was a big guy, Greg Davis, Wow!" McCune said.

Davis was charged with two misdemeanors from the traffic stop, including illegal use of flashing blue lights. He turned himself in at the DeSoto County Jail on Monday evening.

McCune says Davis told him he passed a school bus illegally and drove on the wrong side of the road.

"He comes back and he says, 'I'm going to let you off this time, because you have a clean record,'" McCune said. "'I said thank you so much officer,' And he left."

According to a 2002 Mississippi Attorney General Opinion, "The mayor is not a law enforcement officer and does not have law enforcement authority such as authority to stop traffic."

"I don't know what to say. I've gotten pulled over before, but not by Greg Davis," McCune said as he laughed.

Davis is due in court in May.

Can't help but wonder how many young men Davis pulls over and "pats" down. This is way worse than passing a bus. Once again, if I had done what Davis has done, then I would be in jail.

Unless the official vehicle is CLEARLY a police or fire marshal’s, or if the official is not in the uniform and wears undercover civilian attire, you don’t have to comply with anything. Unless officer specifically (and right away, as soon as he/she makes visible or audible contact with civilian) and clearly states he/she is a government official and provide credentials, such as paperwork or at least, a badge, a civilian has the right: A. not to comply with any instructions issued by the individual, and B. resist any unlawful apprehension, including physical self-defense.

It's not that we are afraid to get him out of office, we CAN'T! The law is on his side. There are 2 ways to get him out, either he resigns or be guilty of a falony. That felony can only come from the State of MS. They seem to be dragging their feet in the investigation of Greg Davis. I only wonder if he has buddies at the state level. Just how long does it take to investigate fraud???? The proof is right in front of them in black and white. It has been almost 6 months! The State of MS and the Boar of Alderman need to have "a little less talk and a lot more action"!

how long do leave a nut in office? i think he must have something on the people of southaven and they are afeard to get him out of office.
