Southaven Mayor Greg Davis Will Not Resign

SOUTHAVEN, MS (abc24.com) - Making his first public appearance since before the Christmas holiday, embattled Southaven Mayor Greg Davis made a brief statement to the media that he would not be stepping down from office.

Davis has reportedly been in rehab since before the holiday. He is under investigation by the state auditor's office for questionable spending of taxpayer dollars. Davis was told he had to pay back or validate $170,000 of expenditures. Among them were claims for travel, stress counseling, expensive dinners with $1,000 tips, $18,000 worth of liquor and $67 at a gay sex shop in Canada. Following a review of $44,000 in receipts and a payment of $96,000 submitted to the state, his new balance is $62,881.89, due immediately.

At a press conference at City Hall on January 30, 2012, Davis stated he had no plans to resign and that he "looked forward to working with everyone." He also spoke briefly on his struggles coming out as a gay man.

The Southaven Board of Aldermen voted to request the mayor's resignation. By law they cannot impeach Davis; he must either resign or be convicted of a felony in order to be removed from office.

The following is a transcript of the statement made by Mayor Greg Davis:

I want to thank everyone for coming out today, but more importantly I want to thank my family, friends and supporters who continue to stand and pray for me throughout this difficult time.


I am looking forward to continuing working for all the citizens of Southaven. For that reason, I have no intentions of resigning. I hope that together with new policies adopted by the board we can continue to work together to move Southaven forward as we have done in the past.


As we move forward I feel certain questions will be answered with factual data and it will be up to each citizen at that point to determine their own reactions.


However, there is one area I would like to address. It concerns the accusations of knowingly deceiving the board. On December 20th, I recall using the word 'deceiving' in a meeting with department heads and later the board in executive session concerning my sexual orientation. I had not only done that to those around me to those who loved me but also to myself. It deeply hurts that some have taken that very personal struggle and manipulated it and twisted it maliciously into something that was never intended.


In the past I too may have reacted in a similar manner, however I believe it is more important to build up than to tear down.


This administration has been and will continue to be constructive, not destructive, and I look forward to working together with everyone.


Again, thank you for coming and I will not be answering any questions at this time.

Well, it doesn't take a rocket scientist to see that this man is a fraud and a thief.. If he hasn't done anything wrong, then why did the Southaven Police Chief, Tom Long, escort him in and out of the press conference today? Is this the Chief's new job responsibility, baby sitting Greg Davis? One would think that the Chief would have more pressing duties, like chasing bad buys. Well, maybe that's what he IS doing! The party is not over yet, the fat lady hasn't sung and she may not sing for a long time. Refresh my memory, when is the next election?

Right, Jeff...no Democrat has ever fell from grace misusing someone else's money. That's all they do! These politicians have no pride. It's all about them. They all believe they make the sun come up. This guy just needs to go. Southaven will be just fine w/o him.

This doesn't have anything to do with sexual orientation. He mis-used taxpayers money and he knew he was doing it! If he hadn't been questioned, this would still be going on and he would be laughing behind all of our backs. He should not be allowed to remain in office. He may have done some great things for Southaven, but he has also taken advantage and used taxpayer money for personal use knowing full well that it was not appropriate!

Actually, I think him being gay is a huge disgrace. A huge disgrace to the gay community. A gay republican. . . it doesn't really get more conflicted than that. Also, I don't think you get much milage out of the "gay" card in Mississippi.

I wish that boy, Jefftao, would try to explain how the poor pay for anything for wealthy Americans / corporations, since they pay zero Income taxes....too much pipe again, huh, Jeffrey?

He fits in right where he is at. In a city of science denying, right wing, religious freak Republicans who claim to be fiscally responsible and morally superior, however, they are anything but. The same party who believes the wealthy and corporations need more government hand outs while the working class, elderly, and poor pay for it. Yes this mayor is right at home among his kind.

Mississippi Code 25-4-109. Penalties; elected and nonelected public servants (1) Upon a finding by clear and convincing evidence that any elected public servant or other person has violated any provision of this article, the commission may censure the elected public servant or impose a civil fine of not more than Ten Thousand Dollars ($ 10,000.00), or both. The commission may further recommend to the Circuit Court for Hinds County that the elected public servant be removed from office. (3) The commission may order restitution or other equitable or legal remedies to recover public funds or property unlawfully taken, as well as unjust enrichment, although not public funds. Any pecuniary benefit received by a public servant in violation of this article may be declared forfeited by the commission for the benefit of the governmental entity injured. (4) In the event a public servant does not appeal the decision or recommendation of the commission, the commission may petition the Circuit Court for Hinds County for the removal, suspension, demotion or reduction of pay of the public servant as provided by law.

No elected or appointed official shall derive any pecuniary benefit, directly or indirectly, as a result of his duties under Chapter 497, Laws of 2009. Any elected or appointed official, any member of the immediate family or any partner or associate of the elected or appointed official, shall not derive any income from the issuance of any bonds or the disposition of any property under Chapter 497, Laws of 2009, contrary to the provisions of Section 109, Mississippi Constitution of 1890, or this article. Code Ann. ยง 25-4-121 (2011) Maybe the citizens of Southaven can get a petition going to have him recalled, since the Board of Aldermen apparently can't do it themselves. Petitions can be started online thru change.org, signon.org, or moveon.org.
