MEMPHIS, Tenn. (localmemphis.com) - The lawyers representing former Memphis Tigers basketball coach and current Georgia Tech coach Josh Pastner have filed a motion for sanctions against Ron Bell and Jennifer Pendley, who accused Pastner of sexual assault.
The motion concerns what attorneys Scott Palumbo and Scott Tompsett say are Bell and Pendley’s repeated refusals to respond to requests for discovery.
Last month, Bell and Pendley’s attorneys Paul Gattone and Ashley Gilpin withdrew from the case. They claimed that their clients have not cooperated with them in regards to discovery evidence, and may have “greatly exaggerated, if not fabricated” the importance of some of the evidence they claimed to have.
The motion includes a transcript of jail calls between Bell and Pendley while he was incarcerated in the pima County Jail and the Cobb County Detention Center for probation violations. According to the transcripts, on a call on March 28th, Bell argued with Pendley about the case, berating her for talking to him on a line that would be recorded and sent to the attorneys.
The attorneys are asking the Superior Court of Arizona to grant the motion of sanctions against Bell and Pendley, and dismiss the couple’s counterclaim “with prejudice,” and enter a judgment in favor of Pastner.
